3. Website & Mobile App Insurance Disclaimer

FlickDirect.com maintains insurance coverage for website and mobile app operations. This coverage does not extend to individual users, third-party services, or external platforms. Use of our Services is at your own risk.

4. Google & YouTube Services

Our website and mobile apps may integrate with Google services, including YouTube API Services, YouTube embedded players, and links to YouTube content. By using features that include YouTube functionality, you agree to comply with YouTube's Terms of Service and the Google Privacy Policy. We do not control or assume responsibility for content on YouTube or other third-party services.

FlickDirect uses YouTube API data only to present or link to related video content and current public statistics. We do not use YouTube API data to create creator profiling tools, channel-inspired generators, substitute YouTube applications, or cross-platform derived analytics products.

5. Intellectual Property & Studio-Provided Content

All website content, designs, logos, text, graphics, and software are copyrighted materials of FlickDirect Inc.

Trademarks: FlickDirect™ and related brand names, such as Movie Deals+™, Movie Hype!™, and Movies NOW!™, are trademarks of FlickDirect Inc.

Studio-Provided Content: Movie stills, trailers, video clips, and promotional assets appearing on FlickDirect.com are provided by film studios, distributors, or their public relations firms for editorial and promotional purposes. FlickDirect does not claim ownership of these materials.

All rights to movie stills, trailers, logos, and official press assets remain with their respective owners. These materials are used under editorial licensing agreements with studios and distributors.

Unauthorized reproduction or redistribution of studio-provided content outside FlickDirect.com without studio permission is strictly prohibited.

6. Use License

You may temporarily download one copy of materials for personal, non-commercial viewing only. Any commercial use, redistribution, or modification without prior written permission is prohibited.

7. Mobile App Usage

By downloading and using the FlickDirect mobile app, you agree to these Terms. Updates to the app may include additional terms, which you agree to by continuing use.

8. Affiliate Disclosure

FlickDirect participates in affiliate marketing programs, including the Amazon Associates Program and affiliate programs for digital retailers such as Apple TV (formerly iTunes). This means we may earn commissions from qualifying purchases or rentals made through links on our site.

These commissions come at no additional cost to you and help support our editorial operations, including news coverage, reviews, interviews, giveaways, and related content.

FlickDirect is independently owned and operated and is not affiliated with, endorsed by, or sponsored by Amazon, Apple, or any other third-party retailer or platform.

10. Limitation of Liability

12. Data Collection & Privacy

We collect and process data as described in our Privacy Policy. Continued use of our Services constitutes consent to our data practices.

13. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes must be resolved exclusively in the courts of Palm Beach County, Florida.

14. Termination

We reserve the right to suspend or terminate your access to our Services at our sole discretion, without notice, for any violation of these Terms.

You agree to indemnify and hold harmless FlickDirect from any claims, damages, or legal fees resulting from your misuse of the Services or violation of these Terms.

17. Age Requirements

FlickDirect is intended for a general entertainment audience. Users under the age of 13 may not create accounts or submit personal information. If you use FlickDirect on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

18. Accounts, Security & User Submissions

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information, promptly update account details, and notify FlickDirect of unauthorized access or suspected security issues.

If FlickDirect permits comments, ratings, check-ins, submissions, messages, contest entries, photos, or other user-provided material, you grant FlickDirect a non-exclusive, worldwide, royalty-free right to host, display, reproduce, moderate, edit for format, distribute, and use that material in connection with operating and promoting FlickDirect services.

You may not submit content that is unlawful, defamatory, infringing, harassing, deceptive, malicious, spam, malware, or otherwise harmful. FlickDirect may remove or restrict content or accounts at its discretion.

19. Subscriptions, In-App Purchases & Platform Billing

Paid app features, subscriptions, trials, renewals, cancellations, refunds, taxes, and billing disputes may be handled by Apple, Google, or another platform provider when purchased through that provider. FlickDirect does not control platform billing systems and cannot guarantee refunds or cancellations outside the applicable platform process.

Subscription terms, pricing, renewal periods, cancellation options, and trial details are presented by the applicable app store or payment platform at the time of purchase and may be subject to that provider's additional terms.

20. Copyright Complaints & DMCA Notices

If you believe content on FlickDirect infringes your copyright, send a notice to legal@flickdirect.com identifying the copyrighted work, the allegedly infringing material, its URL, your contact information, a statement of good-faith belief, and a statement under penalty of perjury that the information is accurate and you are authorized to act.

FlickDirect may remove or disable access to material in response to valid notices and may terminate repeat infringers where appropriate.

21. Dispute Resolution, Arbitration & Class Action Waiver

To the fullest extent permitted by law, disputes arising from or related to FlickDirect, these Terms, the website, or the mobile apps must first be addressed by contacting FlickDirect in good faith. If unresolved, disputes must be resolved through individual binding arbitration in Palm Beach County, Florida, except where a qualifying claim may be brought in small claims court.

You and FlickDirect waive the right to participate in class actions, class arbitration, representative actions, or consolidated proceedings. Claims must be brought individually.

22. Force Majeure, Updates & Contact

FlickDirect is not responsible for delays, outages, failures, data loss, or inability to perform caused by events beyond reasonable control, including network failures, cyber incidents, platform outages, natural disasters, labor disputes, government actions, or third-party service failures.
